SOFT DAY

Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your use of Soft Day, an iPhone app published by Hadger (a trade name of Individual Entrepreneur Шмигирилов Василий Николаевич, ИП ШМИГИРИЛОВ, registered in the Republic of Kazakhstan). By installing or using Soft Day, you agree to these Terms. If you do not agree, do not install or use the app.

2. Apple's role

The app is distributed through the Apple App Store. Apple is not a party to these Terms. Your relationship with Apple is governed by Apple's Standard End-User License Agreement, which applies to Soft Day in addition to these Terms. In case of conflict between Apple's Standard EULA and these Terms, Apple's EULA controls for app-store-specific matters (license scope, distribution).

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Soft Day on iPhones you own or control, for personal, non-commercial use, subject to these Terms and Apple's EULA.

4. Subscription

Soft Day is free to install. After 5 free entries, additional entries require an auto-renewing subscription, currently priced at $0.99 per week with a 7-day free trial (Soft Day Weekly). Pricing is set in the App Store and may vary by region.

Your subscription auto-renews until you cancel. Cancel in Settings → [Your Name] → Subscriptions on your iPhone, at least 24 hours before renewal. Free trials may be canceled the same way before the trial ends; otherwise the subscription becomes paid.

Apple handles all payments. We do not see or store your payment method. Refunds are handled by Apple per Apple's policies.

5. Your content

You own everything you write or speak into Soft Day. Your entries stay on your iPhone. We never receive copies of your entries and never claim any rights to them.

6. Acceptable use

Soft Day is for personal journaling. Do not attempt to reverse-engineer the app, redistribute it, or use it in ways that violate applicable law. The app contains no user-to-user communication, so there is no public-facing content moderation.

7. Disclaimer of warranties

Soft Day is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — express, implied, statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Soft Day is not a medical device and is not a substitute for professional mental-health support.

8. Limitation of liability

To the maximum extent permitted by law, neither Hadger nor ИП ШМИГИРИЛОВ are liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or content. Our total cumulative liability for any claim arising out of or relating to Soft Day shall not exceed the amount you paid us in the twelve months preceding the claim — which, for a $0.99/week subscription, is at most about $52.

9. Termination

You may terminate these Terms at any time by uninstalling the app. We may terminate or suspend access if you materially breach these Terms; in that case any remaining subscription period is forfeited.

10. Governing law and disputes

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Petropavlovsk, Kazakhstan, unless mandatory consumer protection law in your jurisdiction provides otherwise.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be noted in the app's What's New section on App Store and the date at the top of this page will be updated. Continued use of the app after a change indicates acceptance.
